RECOMMENDATION

 

PERMISSION subject to:

 

1.

The development hereby permitted shall be begun before the expiration of three years from the date of this permission. This permission shall be for a period of 40 years from the date that the development is first connected to the grid (the "First Export Date"). Two weeks' notice of this first connection shall be given to the Local Planning Authority in writing.  The development shall be removed and the land restored to its former condition no later than the date 40 years from the First Export Date or within six months of the development failing to generate electricity for 12 consecutive months, whichever occurs first. All structures and materials, and any associated goods and chattels shall be removed from the site and the land shall be restored to its former condition in accordance with a scheme of decommissioning work and land restoration that shall have first been submitted to and approved in writing by the Local Planning Authority. 

Reason: In order that the land is restored to its original condition following the expiry of the period of time whereby electricity is likely to be generated by the proposed development and for which a countryside location has been shown to be essentially required, in accordance with policies COM2 and E2 of the Test Valley Borough Revised Local Plan 2016.

 

2.

The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:

Reason: For the avoidance of doubt and in the interests of proper planning.

 

3.

The vehicular access to the proposed solar farm shall be via an upgraded/widened access from the existing gated field access from Winchester Road. Visibility splays for the new access shall be provided prior to first use of the widened access in accordance with Drawing C22013-ATP-DR-TP-001 providing a visibility splay of 2.4m x 215m. The visibility splay shall be retained for the duration of the operation and nothing over 1m in height shall be erected or be permitted to be planted within the visibility splay.

Reason: To provide satisfactory access and in the interests of

highway safety in accordance with Policy T1 of the Test Valley Borough Revised Local Plan 2016.

 

4.

The proposed widened access into the site shall form the only access and egress point for the site during construction, operation and decommissioning periods.

Reason: To provide satisfactory access/egress to the site in the interests of highway safety in accordance with Policy T1 of the Test Valley Borough Revised Local Plan 2016.

 

5.

Any new gate to be installed at the access into the site shall be set a minimum of 6m back from the edge of the carriageway of Winchester Road.

Reason: To provide satisfactory access and in the interests of

highway safety in accordance with Policy T1 of the Test Valley Borough Revised Local Plan 2016.

 

6.

The development hereby approved shall be undertaken in full accordance with the provisions set out within the Salopian Consultancy Arboricultural Impact Appraisal and Method Statement reference SC:619 dated 10/03/2023.

Reason: To ensure the enhancement of the development by the retention of existing trees and natural features during the construction phase in accordance with Test Valley Borough Revised Local Plan policy E2.

7.

The development shall be undertaken in full accordance with the measures set out in the approved ecological reports and incorporated into the Landscape and Ecology Mitigation and Enhancement Plan (September 2023). The mitigation and enhancement measures shall be permanently maintained and retained for the full duration of the development hereby permitted in accordance with the approved details.

Reason: This is to ensure the favourable conservation status of protected species in accordance with Policy E5 of the Test Valley Borough Revised Local Plan 2016.

8.

No construction process shall be carried out, no machinery shall be operated and no construction or delivery traffic shall enter or leave the site outside the hours of 8.00am - 18.00pm Monday to Friday or 08.00am - 14.00pm on Saturdays, nor at any time on Sundays, Bank or Public Holidays.

Reason:  In the interest of the amenities in the local area in accordance with Test Valley Borough Local Plan 2016 policy LHW4, and to provide satisfactory highway safety in accordance with Policy T1 of the Test Valley Borough Revised Local Plan 2016.

9.

No development shall take place unless or until a construction method statement has been submitted to and approved in writing by the Planning Authority. The method statement shall include:

(a)  A programme of and phasing of demolition (if any) and construction work;

(b)  The provision of long term facilities for contractor parking;

(c)  The arrangements for deliveries associated with all construction works;

(d)  Methods and phasing of construction works;

(e)  Access and egress for plant and machinery;

(f)  Protection of pedestrian routes during construction;

(g)  Location of temporary site buildings, compounds, construction material, and plant storage areas;

Development shall be undertaken in accordance with the approved details.

Reason: To ensure the impact on the highway network is acceptable in accordance with Policy T1 of the Test Valley Borough Revised Local Plan (2016).

10.

Demolition and construction work shall only take place in accordance with the approved method statement. The Construction Method Statement shall be implemented as approved for the duration of the construction works.

Reason: In the interest of the amenities of the local area, and highway safety in accordance with Policies T1 and E8 of the Test Valley Borough Revised Local Plan 2016.

11.

Notwithstanding the Archaeological Geophysical Survey (MOLA 2022), Cultural Heritage Impact Assessment (AA 2023a) and an Archaeological Mitigation Strategy (AA 2023b), no development shall take place until the applicant has secured the implementation of a programme of archaeological evaluation, in accordance with a Written Scheme of Investigation that has been first submitted to and approved in writing by the Planning Authority.

Reason: To assess the extent, nature and date of any archaeological deposits that might be present and the impact of the development upon these heritage assets in accordance with Policy E9 of the Test Valley Borough Revised Local Plan 2016

12.

Following completion of archaeological fieldwork a report shall be produced in accordance with an approved programme submitted by the developer, and approved in writing by the local planning authority, setting out and securing appropriate post-excavation assessment, specialist analysis and reports, publication and public engagement.

Reason: To contribute to our knowledge and understanding of our past by ensuring that opportunities are taken to capture evidence from the historic environment and to make this publicly available in accordance with Policy E9 of the Test Valley Borough Revised Local Plan 2016

13.

All new landscaping to the boundaries of the application site shown on the six approved landscaping drawings (ref Drawing No’s LB417_D01H (Sheets 1 to 6 inclusive)) shall be undertaken in full during the first available planting season following commencement of development on the site. All remaining landscaping on the same drawings shall, at the latest, be undertaken in the first available planting season following first connection of the solar farm to the electricity grid (the "First Export Date").

The landscape works shall be carried out in accordance with the implementation programme and in accordance with the management plan that shall first be submitted to, and approved in writing by the Local Planning Authority. Any trees shall be planted in accordance with the tree-pit details contained in these drawings.

Reason:  To improve the appearance of the site and enhance the character of the development in the interest of visual amenity and contribute to the character of the local area in accordance with Test Valley Borough Revised Local Plan (2016) Policy E1 and E2. Early delivery of the boundary planting will also assist in minimising the effect of glint and glare to houses, road users and aircraft, and providing suitable ecological benefits, in accordance with Policies E5 and E8 of the Test Valley Borough Revised Local Plan (2016).

14.

The development hereby approved shall not be brought into use until a schedule of landscape management and maintenance for a minimum period of 20 years has been submitted to and approved in writing by the Local Planning Authority. The landscape management plan, including long term design objectives, management responsibilities and maintenance schedules for all landscape areas and an implementation programme, shall be submitted to and approved in writing by the Local Planning Authority. The approved management plan shall be carried out in accordance with the implementation programme. Planting shall be implemented within the first available planting season.

Reason: To ensure the provision of amenity afforded by proper maintenance of existing and new landscape features as an

improvement of the appearance of the site and to enhance the character of the development in the interest of visual amenity and contribute to the character of the local area in accordance with Test Valley Borough Revised Local Plan (2016) Policy E1 and E2.

15.

The skylark mitigation as shown on approved drawings TRP1096_11 and MAN3059-ENZ-XX-XX-DR-Z-0001 and as detailed in the Skylark survey report reference MAN.3059.004.EC.R.003 shall be implemented in accordance with the approved details and retained for the lifetime of the permission.

Reason: To ensure protected species known to use the site are protected in accordance with policy E5 of the Test Valley Borough Revised Local Plan (2016).

16.

There shall be no external lighting erection/provided for on the site during the construction or operational phase of the development unless details of such lighting has been first submitted to and approved in writing by the Local Planning Authority. Lighting shall be installed in accordance with the approved details.

Reason: In the interests of the countryside location and to avoid impacts to ecological interests, and the living conditions of nearby dwellings, in accordance with Policies LHW4 and E5 of the Test Valley Borough Revised Local Plan (2016).

17.

Prior to the installation of the first solar panels on site details of the construction and phasing of the proposed new, extended, route of the permissive footpath shown indicatively on Drw.No.LB417_DO1 RevH (Sheets 1 to 6 inclusive) shall be submitted to and approved in writing by the Local Planning Authority. The works shall proceed in accordance with the approved details. The permissive footpath shall be provided and made open to the public prior to the "First Export Date" and this route shall be retained and maintained as such for the lifetime of the permission.

Reason: To ensure the provision of public benefits of new footpath arising from the proposed development in the interests of the recreational access, and associated health benefits in accordance with Test Valley Borough Revised Local Plan (2016) Policies T1(c) and (d) and E2.

18.

Prior to the installation of the first solar panels on site details of the protection of users of the existing permissive footpath from construction activity, shown indicatively on Drw.No.LB417_DO1 RevH (Sheets 1 to 6 inclusive) shall be submitted to and approved in writing by the Local Planning Authority. The works shall proceed in accordance with the approved details and the existing permissive footpath shall be retained for the lifetime of the planning permission.

Reason: To ensure the provision of public benefits of new footpath arising from the proposed development in the interests of the recreational access, and associated health benefits in accordance with Test Valley Borough Revised Local Plan (2016) Policies T1(c) and (d), and E2.

19.

Prior to the “first export date” a scheme for the mitigation of noise generated at the site shall be submitted to and approved in writing by the Local Planning Authority. The noise mitigation scheme shall comprise means of mitigating the impact of noise arising from the plant and equipment to limit the effect of noise to at, or below, background noise levels as indicated in Table 4 of the applicants acoustic report hereby approved. All mitigation measures shall be installed prior to first export date and thereafter be retained and maintained to ensure predicted measures are achieved.

Reason: To ensure satisfactory living conditions at nearby residential properties in accordance with Policy LHW4 of the Test Valley Borough Revised Local plan (2016).

No development (including demolition and site preparation) shall take place until a full Demolition Plan has been submitted to and approved in writing by the Local Planning Authority.  The plan shall include a detailed construction layout and updated vehicle tracking drawings, for actual maximum sized vehicles accessing the site during the demolition period. Development shall be carried out in accordance with the approved details.

Reason:  Details are required prior to commencement in the interests of highway safety in accordance with Test Valley Borough Revised Local Plan 2016 policy T1.

4.

No development (including demolition and site preparation) shall take place until a scheme for the method of demolition has been submitted to and approved in writing by the Local Planning Authority.  The scheme shall include dust control measures and shall detail the means by which impacts from noise and vibration are to be managed. Development shall be carried out in accordance with the approved details.

Reason: Details are required prior to commencement in the interests of amenity in accordance with Test Valley Borough Revised Local Plan 2016 policy E8.

5.

The existing pad foundations shall not be removed until a programme of archaeological monitoring (watching brief), in accordance with a written scheme of investigation, has been submitted to and approved in writing by the Local Planning Authority.  Development shall be carried out in accordance with the approved details.

Reason: To ensure that any archaeological levels that have survived the original development can be recognised and recorded in accordance with Test Valley Borough Revised Local Plan (2016) Policy E9.

6.

In the event that contamination not previously identified is found at any time during demolition and/or construction works at the site, the presence of such contamination shall be reported in writing to the Local Planning Authority without delay and development shall be suspended on the affected part of the site until a remediation scheme for dealing with that contamination has been submitted to and approved in writing by the Local Planning Authority. The approved remediation scheme shall be implemented and, if requested, a verification report, for the purpose of certifying adherence to the approved remediation scheme, shall be submitted to the Local Planning Authority prior to the site being brought in to use.

Reason: To ensure that the development does not contribute to, and is not put at unacceptable risk from or adversely affected by, unacceptable levels of pollution from previously unidentified contamination sources at the development site in accordance with policy E8 of the Test Valley Borough Revised Local Plan 2016.

7.

No work relating to the development hereby approved, including works of demolition or preparation prior to operations, shall take place before the hours of 0800 nor after 1800 on Mondays to Fridays; before the hours of 0800 nor after 1300 on Saturdays; and not at all on Sundays and public holidays.

Reason: In the interests of amenity in accordance with Test Valley Borough Revised Local Plan 2016 policy E8.

8.

Any temporary site lighting necessary for the demolition and construction process shall be positioned so as to avoid light spill or glare at neighbouring residential properties.

Reason: In the interests of amenity in accordance with Test Valley Borough Revised Local Plan 2016 policy E8.

9.

No hoardings shall be installed at the site until full details, including scaled drawings and timings for installation, have been submitted to and approved in writing by the Local Planning Authority.  Development shall be carried out in accordance with the approved details.

Reason: To ensure that the character, appearance and setting of heritage assets is sustained in accordance with Test Valley Borough Revised Local Plan 2016 Policy E9.

10.

No new walls or roofs shall be erected until samples and details of the materials to be used in their construction have been submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved details.

Reason:  To ensure the development has a satisfactory external appearance in the interest of visual amenities in accordance with Test Valley Borough Revised Local Plan (2016) Policy E1.

11.

No generators shall be operated on site in association with the development hereby permitted outside of the working hours set out within condition 7.

Reason: In the interests of amenity in accordance with Test Valley Borough Revised Local Plan 2016 policy E8.

12.

Vehicles and mobile plant operating on site in association with the development hereby permitted shall not use tonal reversing bleepers.

Reason: In the interests of amenity in accordance with Test Valley Borough Revised Local Plan 2016 policy E8.

 

 

13.

The development hereby permitted shall be carried out in accordance with the submitted Tree Protection Plan (drawing reference “Arbtech TPP01-Demo Revision B”).  The installed tree protective measures shall be inspected and approved by the Test Valley Borough Council Arboricultural Officer who shall be given at least 5 days notice of the completion of their installation.

Note: The submitted tree protection plan notes the requirement for a pre-commencement site meeting together with relevant supervision requirements for excavations and the erection of hoarding.  These works will need to be overseen carefully by the project arboriculturist and reported back to the Local Planning Authority. 

Reason: To ensure the enhancement of the development by the retention of existing trees and natural features during the demolition and construction phase in accordance with Test Valley Borough Revised Local Plan policy E2.

14.

The development hereby permitted shall be carried out in accordance with the avoidance, mitigation, compensation and enhancement recommendations contained within the submitted Preliminary Ecological Appraisal and Roost Assessment (prepared by Arbtech Consulting Ltd, dated 18 September 2024) and Ecological Management and Bat Mitigation Plan (prepared by Arbtech Consulting Ltd, dated 19 December 2024).

Note: Details of the Biodiversity Champion to oversee the works shall be provided to the Local Planning Authority as a point of contact.

Reason: To conserve and enhance biodiversity in accordance with Policy E5 of the Test Valley Borough Revised Local Plan 2016.

15.

The demolition of the existing building shall not be undertaken before a planning application for a proposed redevelopment of the site has been submitted to and registered by the Local Planning Authority.

Note: This condition does not preclude any internal preparatory works needed prior to the full demolition of the existing building.

Reason: To prevent the premature demolition of the building in accordance with Test Valley Borough Revised Local Plan 2016 policy E9.

16.

Following the completion of the demolition works hereby permitted, written verification from a competent person certifying that all asbestos-containing materials have been removed from the site shall be submitted to and approved in writing by the Local Planning Authority.  This should be informed by an asbestos management survey carried out prior to any demolition works taking place.  Removal and disposal must be done in accordance with all legal requirements.

Reason:  To ensure a safe working environment in accordance with Test Valley Borough Revised Local Plan (2016) Policy E8.

The various trees standing within and adjacent to this site are protected by virtue of standing within the Andover Conservation Area. Damage to the trees is an offence under the Town and Country Planning Act 1990. Failure to comply with the tree protection conditions above is likely to result in damage to the trees. Tree damage may lead to the prosecution of those undertaking the work and those causing or permitting the work.
