Reason: For the avoidance of doubt and in the interests of proper planning.

3.

No development shall take place above DPC level of the development hereby permitted until samples and details (including any timberwork staining) of the materials to be used in the construction of all external surfaces hereby permitted have been submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved details.

Reason: To ensure the development has a satisfactory external appearance in the interest of visual amenities in accordance with Test Valley Borough Revised Local Plan (2016) Policy E1.

4.

No development shall take place above DPC level of the development hereby permitted until full details of hard and soft landscape works have been submitted and approved. Details shall include:

I. proposed finished levels or contours;

II. means of enclosure;

III. hard surfacing materials;

IV. retained historic landscape features and proposals for restoration, where relevant;

V. planting plans;

VI. written specifications (including cultivation and other operations associated with plant and grass establishment);

VII. schedules of plants, noting species, plant sizes and proposed numbers/densities, including hedgerow density and percentage mix (any tree planting shall be at least 5m from the boundary of the Public Right of Way);

VIII. programme of implementation and management.

IX. The landscape works shall be carried out in accordance with the approved details and the implementation programme.

Reason: To enable the development to respect, complement and positively integrate into the character of the area in accordance with Test Valley Borough Revised Local Plan (2016) Policies E1 and E2.

5.

No development shall take place above DPC level of the development hereby permitted until a schedule of landscape management and maintenance for a minimum period of 5 years has been submitted to and approved in writing by the Local Planning Authority. The landscape management plan shall include long term design objectives, management responsibilities and maintenance schedules for all landscape areas. The landscaping shall be maintained in accordance with the approved schedule. Any trees or planting that are removed, die or become, in the opinion of the Local Planning Authority, seriously damaged or defective within this period, shall be replaced before the end of the current or first available planting season following the failure, removal or damage of the planting.

Reason: To enable the development to respect, complement and positively integrate into the character of the area in accordance with Test Valley Borough Revised Local Plan (2016) Policies E1 and E2.

6.

No development shall commence (including site clearance and any other preparatory works) until a scheme for the protection of trees to be retained has been submitted to and approved in writing by the Local Planning Authority. Such a scheme shall include a plan showing the location and specification of tree protective barriers. Such barriers shall be erected prior to any other site operations and at least three working days' notice shall be given to the Local Planning Authority that it has been erected.

Note: The protective barriers shall be as specified at Chapter 6.2 and detailed in figure 2 of B.S.5837:2012 unless otherwise agreed in writing with the Local Planning Authority.

Reason: To ensure the enhancement of the development by the retention of existing trees and natural features during the construction phase in accordance with Test Valley Borough Revised Local Plan (2016) Policy E2.

7.

Development shall proceed in accordance with the measures set out in Section 5 of the Land to the rear of The Wayne, Fyfield, Bat Scoping Survey and Ecological Assessment (The Ecology Co-op, 2nd August 2024). Thereafter, mitigation and enhancement features shall be permanently maintained and retained in accordance with the approved details.

Reason: To ensure the favourable conservation status of bats in accordance with Policy E5 of the Test Valley Borough Revised Local Plan (2016).

8.

No external lighting shall be installed unless in accordance with details that have been submitted to and approved in writing by the Local Planning Authority. The details shall include plans and details sufficient to show the location, type, specification, luminance and angle of illumination of all lights/luminaires and a light spread diagram

Reason: To safeguard the visual amenities of the area, in the interest of protected species and to safeguard the residential amenities of neighbouring properties in accordance with Test Valley Borough Revised Local Plan (2016) Policies E1, E5, and LHW4.

9.

No development shall take place (including any works of demolition) until a Construction Method Statement has been submitted to, and approved in writing by, the Local Planning Authority. The approved statement shall include scaled drawings illustrating the provision for –

1) The parking of site operatives and visitors vehicles.

2) Loading and unloading of plant and materials.

3) Management of construction traffic and access routes.

4) Storage of plant and materials used in constructing the development.

5) Vehicle tracking demonstrating that the largest vehicles associated with the construction process can access, egress and turn within the confines of the site.

6) A scheme detailing the method of cleaning wheels and chassis of all HGV’s, plant and delivery vehicles leaving the site and the means of keeping the site access road and adjacent public highway clear of mud and debris during site demolition, excavation, preparation and construction.

7) Development shall proceed in accordance with the approved details.

Reason: In the interests of highway safety in accordance with Policy T1 of the Test Valley Borough Revised Local Plan (2016).

10.

The development hereby permitted shall not be brought into use until vehicular visibility splays as detailed in the Technical Note (Highgate Transportation, August 2024 ref. HTp/2477/TN/01) in which there should be no obstruction to visibility exceeding 600mm in height above the adjacent carriageway channel line have been completed. The vehicular visibility splays shall thereafter be retained for the lifetime of the development.

Reason: To provide and maintain adequate visibility in the interests of highway safety in accordance with Policy T1 of the Test Valley Borough Revised Local Plan (2016).

11.

The development shall not be brought into use until all areas indicated to be used for vehicles and pedestrians on the approved plans have been laid out with a hardened, sealed and drained surface. Provision shall be made to direct run-off water from the hard surface to a permeable or porous area or surface within the development boundary. Such areas shall be retained as such for the lifetime of the development.

Reason: In the interests of highway safety in accordance with Policy T1 of the Test Valley Borough Revised Local Plan (2016).

12.

No vehicles (including builders and contractors), machinery, equipment, materials, spoil, scaffolding, or anything else associated with the works, use, or occupation to the development, shall be left on or near to a Public Right of Way as to cause obstruction, hindrance, or a hazard to the legitimate users.

Reason: To ensure the protection of public safety along the Public Right of Way network in accordance with Policy T1 of the Test Valley Borough Revised Local Plan (2016), and no offence is committed under the Highways Act 1980

13.

The development hereby approved shall be designed and built to meet Regulation 36 2 (b) requirement of 110 litres/person/day water efficiency set out in part G2 of Building Regulations 2015.

Reason: In the interests of improving water usage efficiency in accordance with policy E7 of the Test Valley Borough Revised Local Plan 2016.

14.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order amending, revoking or re-enacting that Order), no building, structure, walls or fences of any kind shall be erected without the prior written consent of the Local Planning Authority.

Reason: In order that the Local Planning Authority can exercise control in the locality in the interest of the local amenities in accordance with Test Valley Borough Revised Local Plan (2016) Policy COM2, E1 and E2.

15.

All works of demolition, construction and other associated activity, including the making and receiving of deliveries to the site during the construction/demolition period, shall only take place between the hours of 0800 – 1800hrs Monday to Friday and 0800 – 1300hrs on Saturday. No such activity shall take place on Sundays or public holidays.

Reason: To ensure all activity associated with the demolition and construction period – including deliveries take place, are undertaken at times appropriate to this location. Having regard to both noise, vibration, and potential conflict with road users in this location, in accordance with Policies E8 and T1 of the Test Valley Borough Revised Local Plan (2016).

16.

No occupation of the dwellings hereby permitted shall be allowed to take place unless or until the dwellings are connected to mains foul sewer.

Reason: To ensure a suitable solution for foul water disposal is in place to minimise the risk of pollution in accordance with Policy E8 of the Test Valley Borough Local Plan (2016).

Notes to Applicant:

1.

In reaching this decision Test Valley Borough Council (TVBC) has had regard to the National Planning Policy Framework and takes a positive and proactive approach to development proposals focused on solutions. TVBC work with applicants and their agents in a positive and proactive manner offering a pre-application advice service and updating applicants/agents of issues that may arise in dealing with the application and where possible suggesting solutions.

2.

Bats and their roosts receive strict legal protection under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017. All work must stop immediately if bats, or evidence of bat presence (e.g. droppings, bat carcasses or insect remains), are encountered at any point during this development. Should this occur, further advice should be sought from Natural England and/or a professional ecologist.

3.

Birds' nests, when occupied or being built, receive legal protection under the Wildlife and Countryside Act 1981 (as amended). It is highly advisable to undertake clearance of potential bird nesting habitat (such as hedges, scrub, trees, suitable outbuildings etc.) outside the bird nesting season, which is generally seen as extending from March to the end of August, although may extend longer depending on local conditions. If there is absolutely no alternative to doing the work in during this period then a thorough, careful and quiet examination of the affected area must be carried out before clearance starts. If occupied nests are present then work must stop in that area, a suitable (approximately 5m) stand-off maintained, and clearance can only recommence once the nest becomes unoccupied of its own accord.

4.

The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition "(the biodiversity gain condition") that development may not begin unless:

a) a Biodiversity Gain Plan has been submitted to the planning authority, and

b) the planning authority has approved the plan.

The planning authority, for the purposes of determining whether to approve a Biodiversity Gain Plan if one is required in respect of this permission would be Test Valley Borough Council. There are statutory exemptions and transitional arrangements which mean that the biodiversity gain condition does not always apply. However, based on the information available this permission is one which will require the approval of a biodiversity gain plan before development is begun because none of the statutory exemptions or transitional arrangements are considered to apply. Development shall proceed in accordance with any such approved details, with the approved Biodiversity Gain Plan maintained for the minimum of the 30 years which is set in the Environment Act 2021.

5.

There must be no surface alterations to a Public Right of Way without the consent of Hampshire County Council as Highway Authority via a Section 278 agreement. Planning permission under the Town and Country Planning Act 1990 does not provide this and separate consent is required. To carry out any such works without this permission would constitute an offence under Section 131 of the Highways Act 1980.

REFUSED for the reason:

1.

The proposal to extend the hours of operation across two days at the site would have the effect of increasing activity associated with a retail operation across a longer period of each of those days. The additional hours would facilitate increased activity and associated noise levels during two days which are considered to be particularly sensitive to change. Particularly in relation to the living conditions of residents of The Cottage. These periods of time comprise Friday evening and Saturday. As a consequence of both the increased activity associated with a retail use operating in this rural location, and the location of The Cottage, relative to the noisy activity the proposal would significantly and adversely affect the quiet enjoyment of the external- private space that serve that home, to the overall detriment of living conditions in that home. The proposal would be contrary to Policies LHW4 and E8 of the Test Valley Borough Revised Local Plan (2016).
