Exclusion Of The Press And Public - Legal Advice
At a predetermined point during the consideration of all items the Sub-Committee may move into private session in order to receive legal advice when determining issues. The parties to the hearing, press and public, unless otherwise excluded by the Licensing Act 2003 (Hearings) Regulations 2005, will be invited to return immediately following that private session at which time the matter will be determined and the decision of the Sub-Committee will be announced.

Licensing Application- Worldwide Grocerrie 298 Burgess Road Southampton, SO16 3BJ

The Sub-Committee considered the report of the Service Director – Communities, Culture and Homes for an application for a premises licence in respect of a New Premises Licence - Worldwide Grocerrie 298 Burgess Road SO16 3BJ
Karan Nayyer ( applicant), Matt Taylor ( Environmental Health) and Mr and Mrs Shepherd ( representors) were present and with the consent of the Chair, addressed the meeting.
The Sub-Committee considered the decision in confidential session in accordance with the Licensing Act (Hearings) Regulations 2005.
All parties will receive formal written confirmation of the decision and reasons.
Decision:
This hearing was held as a hybrid hearing with all attendees attending virtually using Microsoft Teams.
The Sub-Committee has considered very carefully the application for grant of a premises licence for Worldwide Grocerrie 298 Burgess Road Southampton, SO16 3BJ as submitted.
It has given due regard to the Licensing Act 2003, the Licensing Objectives, statutory guidance and the adopted statement of Licensing Policy. The Human Rights Act 1998, The Equality Act 2010 and The Crime and Disorder Act 1998 Section 17.
The Sub-Committee made its decision on the basis of all of the evidence submitted, both in writing and given orally at the Hearing.
The Sub-Committee considered and heard evidence from the applicant.
The Sub-Committee noted that the following Responsible Authorities, Environmental Health, attended the Hearing and made representations.
The Sub-Committee heard from two residents and considered the written representations.
Having considered all the above, the Sub-Committee agreed to grant the licence, subject to the conditions set out in the email from Matt Taylor of Environmental health to the applicant on 25 October 2024, conditions 1,3, 4, 5 & 6 agreed by Hampshire Constabulary plus the following: -
- A night hatch will be used between 23.00 and closure. No customer to have access to the premises during this time.
- Supply of alcohol is extended to 00.00 on all public holidays
- Delivery services – all deliveries shall be delivered to an address with a valid door number / house name and postcode. The drop off point shall match that which the order was placed to. Redirection must be refused. Orders shall only be given to the person matching the name on the delivery post completion of ID checks confirming that they are over 18. ID will be required at all times for delivery.
- Management will ensure that delivery drivers shall conduct themselves in a manner that will not cause a noise disturbance to occupiers of residential properties surrounding the premises or delivery addresses. Drivers shall turn off the engines immediately upon arrival and will park considerately without causing any obstruction to the highway

Reasons:
The Sub-Committee has listened to the concerns of residents about the impact on the local area as a result of public nuisance. The Committee took into consideration that legislation provides for a presumption of grant of an application for a premises licence, subject to the determination of the application with a view to promoting the licensing objectives in the overall interests of the local community. No evidence was provided to suggest the objectives could not be upheld with implementation of conditions above. Concerns were raised about the extensive hours applied for and the Sub – Committee agreed that the extended late-night opening created a greater risk of public nuisance and crime and disorder.
The representation from environmental health was concerned with the impact on the local community from the late-night opening and the extended hours. They are the experts in this area. The sub-committee agreed that such hours would be likely to cause a nuisance.
The residents and objections were keen to highlight the lack of parking available in the area.
