The Committee considered a proposal by Councillor Lloyd and seconded by Councillor Fairhurst that application APP/24/00186 be deferred to a future meeting of the Committee.
The Committee considered that in view of the unique nature of the proposal, the members had been given insufficient time to properly digest the information that was provided in the papers issued after the agenda was published. It was therefore
RESOLVED that application APP/24/00186 be deferred to enable Members of the Committee to digest the information provided in the agenda and update papers, and for officers to organize a briefing.

Proposal: Demolition of existing dwelling and replacement with 4No 2bed, 8No 3bed, 2No 4bed dwellings and 1No. 5bed dwelling.
The Committee considered the written report and recommendation from the Head of Planning to grant permission.
The Committee received supplementary information, circulated prior to the
meeting, which included:
1. Written deputations submitted by
a. Mr Jackson
b. Mr Ford
c. Mr Stallan, the applicant’s agent
2. an addendum update
The Committee was addressed by:

In response to questions from members of the Committee, Mr Stallan confirmed that:
· The affordable homes’ prices in the proposal would be controlled by the legal agreement.
·The appropriate statutory consultees had been consulted in regard to the drainage of the proposed site, and they had concluded the application would be acceptable.
The officers commented on the issues raised by public speakers and in the written submissions as follows:
· The 1998 planning permission that was referred to was introduced before the adoption of the development plan in 2011, in which the efficient use of land would form part of the current adopted policy.
· The distances between flats, at an angle, would be between 10 to 5.5. metres to the boundary.
· Southern Water had raised no objections to the proposal subject to a condition relating to foul and surface water.
· The Lead Local Flood Authority was satisfied with the surface water drainage of the site.
In response to questions from members of the Committee, officers indicated that:
a. The snow gum tree on the site was to be considered by the Arboricultural officer as to whether it was worthy of protection by Tree Preservation Order.
b. The lines of sight from the access of the site would be up to 43 metres, and one of the trees on the highway would have to be crown lifted to achieve this level of lines of sight.
c. The Highway Authority had raised no objection to the proposal.
d. The proposed dwellings had windows which faced the south and west.
e. The Lead Local Flood Authority had raised no objection to the proposal.
f. Condition 10 of the proposal included a management and maintenance plan for the surface water drainage system for the lifetime of the development.
The Committee discussed the application in detail together with the views raised by public speakers.
The Committee considered the proposed number of houses on the site, the planning history of the application, the negative impact of the proposal on the mature trees on the site, the limited number of windows of the proposed dwellings within the site, the flood risk of the site, the prospect of appeal if the application were to be rejected by the Committee, and the access to the site.
RESOLVED that application APP/23/01078 be refused for the following reason and such other reasons as the Executive Head of Place considers appropriate after consultation with the Chairman of the Committee:
1. The proposed development is an overdevelopment of the site’s location by virtue of the number of dwellings to be set among established mature trees. It would be detrimental to the character of the neighbourhood and the natural environment, contrary to Policies CS11 and CS16 of the Havant Borough Local Plan (Core Strategy) 2011, Policy D3 of the Emsworth Neighbourhood Plan 2019 – 2036 and the National Planning Policy Framework.
2. Binding arrangements are not in place to secure the following aspects of the development, as a result of which it is not considered that the development could be undertaken in a satisfactory manner:
i) Affordable Housing;
ii) Solent Recreation Mitigation Strategy
iii) Mitigation of nutrients;
iv) Public Access;
v) Site Management; and
vi) Associated monitoring fees.
The carrying out of the development in the absence of such provision would result in an unsatisfactory and unsustainable form of development having due regard to Policies CS9, CS11, CS16, CS19, CS21 and DM8, DM11 of the Havant Borough Local Plan (Core Strategy) 2011; Policy DM24 of the Havant Borough Local Plan (Allocations) 2014; Policy L1 of the Emsworth Neighbourhood Plan 2019 – 2036; the Conservation of Habitats and Species Regulations 2017 (as amended); and the National Planning Policy Framework.
