The Senior Democratic Services Officer introduced a scheme for speaking at the Planning Committee, which incorporates the current rules and practices into a single document with some minor changes.
The report and options available to the Committee were discussed in detail.
Following a question and answer session, debate and vote, the Committee agreed the report’s recommendations for the reasons stated in the submitted report.

In response to questions from members of Committee, Councillor Diamond added that she is concerned that the safety of the junction could worsen when construction begins.

The officers commented on the issues raised by public speakers and in the written submissions as follows:
· In regard to the private access road’s junction with St John’s Avenue, the splay to the right on exit had originally been partially compromised due to the road alignment.

a. The applicant has served notice on the owner of 1 Minters Lepe, which was required by law.
b. The application’s room size is estimated to be proportionate to its counterpart of 1 Minters Lepe.

The implementation of all such approved landscaping shall be completed in full accordance with such approved timing provisions. (a) A water efficiency calculation in accordance with the Government's National Calculation Methodology for assessing water efficiency in new dwellings has been undertaken which demonstrates that no more than 110 litres of water per person per day shall be consumed within the development, and this calculation has been submitted to, and approved in writing by, the Local Planning Authority; and
(b) All measures necessary to meet the approved water efficiency calculation have been installed.
Reason: There is existing evidence of high levels of nitrogen and phosphorus in the water environment with evidence of eutrophication at some European designated nature conservation sites in the Solent catchment. The PUSH Integrated Water Management Strategy has identified that there is uncertainty as to whether new housing development can be accommodated without having a detrimental impact on the designated sites within the Solent. No development shall commence on site unless and until an Arboricultural Method Statement (AMS) including a program for its implementation has been submitted to and approved in writing by the Local Planning Authority. Notwithstanding the details on the hereby approved plans, the AMS shall include details of a NO-DIG cell web type construction to be used within the Root Protection Areas (RPAs) of trees and plans showing the calculated diameter of the RPAs. Thereafter the development shall be implemented fully in accordance with the approved AMS.
Reason: To ensure that the trees on and around the site are adequately protected from damage to their health and amenity value, and having due regard to policies CS13 and DM8 of the Havant Borough Local Plan (Core Strategy) 2011 and the National Planning Policy Framework. It is considered necessary for this to be a pre-commencement condition as these details need to be agreed prior to the construction of the development and thus go to the heart of the planning permission.

Notwithstanding the details shown on the hereby approved plans, no new lighting shall be installed until a lighting scheme, designed to minimise light spill and impacts on wildlife, particularly bats, has been submitted to and approved in writing by the Local Planning Authority. The scheme shall provide information on the specification, lux, direction and screening of the lights to be installed and shall include plans showing predicted light spillage contours in relation to identified ecological features. Thereafter the lighting shall be installed and maintained in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority.
Reason: In order to avoid and minimise impacts of artificial lighting on the ecological interest of the site and to prevent harm to visual amenityand having due regard to policies DM10 and CS16 of the Havant Borough Local Plan (Core Strategy) 2011 and the National Planning Policy Framework..

The implementation of this planning permission shall be carried out in accordance with the summary section of the submitted Ecology Screening Report (HCC Ecology, September 2022). Construction work shall be completed outside the main nesting season of March to August. If this is not possible, a nesting bird check shall be conducted by a suitably experience ecologist no sooner than 24 hours prior to any construction work commencing. If any active nests are found to be present, a suitable buffer of approximately 5m shall be instigated around the nest and this shall be left undisturbed, with no noisy works to be undertaken, until the nests have naturally become no longer active, i.e. young have fledged and left the nest area.
Reason: To ensure that the protection of ecology and/or biodiversity is fully taken into account during the construction process in order to ensure the development will not be detrimental to the maintenance of the species, and having due regard to policy CS16 of the Havant Borough Local Plan (Core Strategy) 2011 and the National Planning Policy Framework.

Notwithstanding any details contained on the plans hereby approved, prior to the first use of the development or within the first planting season after the practical completion of the earthworks, whichever is the sooner, the areas of new landscaping shall be seeded with a grass seed that shall include a wildflower mix element suited to clay soils, unless otherwise agreed in writing by the Local Planning Authority.
Reason: In the interest of biodiversity and having due regard to policy CS16 of the Havant Borough Local Plan (Core Strategy) 2011 and the National Planning Policy Framework.

No development shall commence on site unless and until an Arboricultural Method Statement (AMS) including a program for its implementation has been submitted to and approved in writing by the Local Planning Authority. Notwithstanding the details on the hereby approved plans, the AMS shall include details of a NO-DIG cell web type construction to be used within the Root Protection Areas (RPAs) of trees and plans showing the calculated diameter of the RPAs. Thereafter the development shall be implemented fully in accordance with the approved AMS.
Reason: To ensure that the trees on and around the site are adequately protected from damage to their health and amenity value, and having due regard to policies CS13 and DM8 of the Havant Borough Local Plan (Core Strategy) 2011 and the National Planning Policy Framework. It is considered necessary for this to be a pre-commencement condition as these details need to be agreed prior to the construction of the development and thus go to the heart of the planning permission.

Notwithstanding the details shown on the hereby approved plans, no new lighting shall be installed until a lighting scheme, designed to minimise light spill and impacts on wildlife, particularly bats, has been submitted to and approved in writing by the Local Planning Authority. The scheme shall provide information on the specification, lux, direction and screening of the lights to be installed and shall include plans showing predicted light spillage contours in relation to identified ecological features. Thereafter the lighting shall be installed and maintained in accordance with the approved details, unless otherwise agreed in writing by the Local Planning Authority.
Reason: In order to avoid and minimise impacts of artificial lighting on the ecological interest of the site and to prevent harm to visual amenityand having due regard to policies DM10 and CS16 of the Havant Borough Local Plan (Core Strategy) 2011 and the National Planning Policy Framework..

The implementation of this planning permission shall be carried out in accordance with the summary section of the submitted Ecology Screening Report (HCC Ecology, September 2022). Construction work shall be completed outside the main nesting season of March to August. If this is not possible, a nesting bird check shall be conducted by a suitably experience ecologist no sooner than 24 hours prior to any construction work commencing. If any active nests are found to be present, a suitable buffer of approximately 5m shall be instigated around the nest and this shall be left undisturbed, with no noisy works to be undertaken, until the nests have naturally become no longer active, i.e. young have fledged and left the nest area.
Reason: To ensure that the protection of ecology and/or biodiversity is fully taken into account during the construction process in order to ensure the development will not be detrimental to the maintenance of the species, and having due regard to policy CS16 of the Havant Borough Local Plan (Core Strategy) 2011 and the National Planning Policy Framework.

Notwithstanding any details contained on the plans hereby approved, prior to the first use of the development or within the first planting season after the practical completion of the earthworks, whichever is the sooner, the areas of new landscaping shall be seeded with a grass seed that shall include a wildflower mix element suited to clay soils, unless otherwise agreed in writing by the Local Planning Authority.
Reason: In the interest of biodiversity and having due regard to policy CS16 of the Havant Borough Local Plan (Core Strategy) 2011 and the National Planning Policy Framework.

RESOLVED that application APP/24/00130 be refused for the following reasons:
1. The proposal by virtue of introduction of a large expanse of hardstanding would be detrimental to the visual amenities of the streetscene as it would puncture the strong, predominantly green frontage in Tower Gardens. The proposal would fail to preserve the character and appearance of the Conservation Area and would result in less than substantial harm to its significance. The public benefits would be limited and would not outweigh the less than substantial harm to the significance of the Conservation Area. Furthermore, the proposal would fail to conserve and enhance the special qualities of the National Landscape (Chichester Harbour AONB). The proposal is therefore contrary to policies CS11, CS12 and CS16 of the Havant Borough Local Plan (Core Strategy) 2011 and DM20 of the Havant Borough Local Plan (Allocations) 2014, the Chichester Harbour AONB Management Plan and the Chichester Harbour AONB SPD, the National Planning Policy Framework (December 2023) and Section 72(1) of the Planning (Listed Building and Conservation Areas) Act 1990.
