Minutes
Members considered a report which provided information on the Terms of Reference approved by Council at its Annual Meeting on 23 May 2025. The Committee noted that the Terms of Reference remained unchanged from the previous years.
The report also contained information on the procedure for Licensing Hearings held under the Licensing Act 2003, Gambling Act 2005, Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976. The procedures to be followed, were set out in Appendices B1 to B3 of the report. The procedures outlined how hearings would be conducted for the application of premises licences and reviews and taxi licences and hackney carriage applications and hearings.
The report also provided information on a number of other things including the delegation of functions, the appointment of Members onto the Licensing Sub Committee and the procedure for settling of appeals after a Sub Committee Hearing. All these points were covered in greater detail in the appendices attached to the report.
Members were afforded the opportunity to ask any questions on any of the points contained within the report, which officers answered, providing clarity.
RESOLVED that:-
1) Members note the Terms of Reference for the Licensing Committee and Sub-Committee, which remain unchanged and are shown at Appendix A to the report;
2) Members note the procedure for hearings, which remain unchanged and are set out at Appendix B1-B3 of the report, are the procedures for Licensing Committee and Sub-Committee Hearings, held under the Licensing Act 2003, Gambling Act 2005, Town Police Clauses Act 1847 and Local Government (Miscellaneous Provisions) Act 1976;
3) Members agree the delegation of functions, which remain unchanged and are set out at Appendix C1-C3 of this report;
4) Members agree the appointment of Members to the Licensing Sub Committee, which remains unchanged and is set out at Appendix D to the report; and
5) Members agree the procedure for dealing with the settling of appeals, after a Sub-Committee hearing, but before the appeal hearing in the Magistrates Court, which is unchanged and is set out at Appendix E to the report.

David Smith, Licensing Officer presented a report to Members which provided updates on the activities of the Licensing Committee, Licensing Sub Committees and the Licensing Service.
The report provided a summary of the past year, outlining that there had been 45 Licensing Sub Committee Hearings held in 2024/25, with 36 of these relating to Hackney Carriage or Private Hire Licensing. These numbers wee greater than those considered in previous years, with over 15 more hearings held in 2024/25 than the previously.
The report also provided a horizon scan on future piece of work that the Committee would be considering, including the Statement of Licensing Policy, which would be considered by the Committee in the Autumn, and approved by Full Council following this.
Members were afforded the opportunity to comment on the report, prior to consideration of the recommendations.
RESOLVED that: -
1) Members note the 2024/25 Licensing Sub Committee / Sub Committee Summary shown at Appendix A;
2) Members note the summary and comparison of applications received by the Licensing Service, and summary of the number of existing licences, shown at Appendix B;
3) The Committee note the Licensing Structure Diagram, which provides a brief overview of Licensing Service Staff roles, attached at Appendix C to the report; and
4) Members of the Committee note the ‘Horizon Scan’ which summarises upcoming policy determinations which will be presented to Members for consideration at future Committee meetings, shown at Appendix D.
