Minutes
The Sub-Committee considered an application for a new premises licence for 2 Owston Road, Carcroft, Doncaster, DN6 8DL.
The Sub-Committee Members, the Applicant and any persons making representations had received a copy of the agenda papers prior to the meeting. A copy of the representations was attached at Appendix B.
The Senior Licensing Practitioner introduced the report and outlined the key points to the application.
The Applicant attended the meeting, made representations and answered questions.
No Objectors were present at the meeting.
At the commencement of the meeting, the Chair welcomed everyone and outlined the procedure to be followed.
All parties were then asked to leave the meeting whilst the sub-committee deliberated on the application and reached a decision.
RESOLVED that having considered the application for a new premises licence in respect of 2 Owston Road, Carcroft, Doncaster, taken into account the written representations made, the evidence presented today, the steps that are appropriate to promote the Licensing Objectives, the Home Office Guidance and our Statement of Licensing Policy and have decided to grant the application, subject to an amendment of the timings for sale of alcohol and opening hours.
The licence will authorise the sale of alcohol until 10:30pm and require the premises to close no later than 11:00pm. This is considered necessary to promote the licensing objective of the prevention of public nuisance.
The licence will be subject to the conditions already agreed with South Yorkshire Police and listed at Appendix B. In addition, the Sub-Committee has imposed the following conditions which are considered necessary in the interests of promoting the licensing objective of the prevention of public nuisance: -
• Patrons permitted to temporarily leave and then re-enter the premises to smoke shall be restricted from using the area at the front of the premises as a designated smoking area.
• Notices to be displayed saying “No Smoking” at the area to the front of the premises.
• Notices shall be prominently displayed at any area designated for smoking requesting patrons to respect the needs of local residents and use the area quietly.
The Sub-Committee heard from the applicant and made the decision for the following reasons. The applicant wishes to open a small elegant wine bar, previously used as a small café which had a ‘bring your own bottle’ policy. The applicant expressed there has been an overall positive response from the community surrounding the opening.
The Sub-Committee were concerned that the venue may attract crowds of people. In response the applicant reassured the Sub-Committee that it expects a more mature customer base and has received a largely positive response for the property to be used as a wine bar. The previous owner hosted event evenings such as wreath making, which were extremely popular and which the applicant wishes to continue.
When asked about the use of the smoking area and whether there would be the possibility to use another designated area for smoking, the applicant expressed a willingness to discuss with residents as to where the smoking area could be located by either using areas at the front of the premises, the rear of the premises, or at another building where there is a toilet and store cupboard, away from the main premises.
The Sub-Committee raised the concerns of glasses being taken outside but accepted that having plastic glasses would be impractical. The Sub-Committee were reassured that there will be no seating in the smoking area, which will mitigate this concern.
The Sub-Committee raised queries surrounding opening hours, noting the premises location is sited within a residential area. The Applicant confirmed that an earlier closing time would be acceptable.
The Sub-Committee considered written objections, including an e-mail sent to City of Doncaster Council by an existing objector on 27th November 2024. The concerns raised in those written representations, namely concerns around noise nuisance from patrons at the premises, music being played at the premises and concerns around road safety on a busy crossroads. It was also noted the concerns around deliveries to the premises. The applicant will work with the council to reduce noise in relation to music. The applicant said she is working with the council to have this tested to protect residents, particularly the resident living above the premises and will also install CCTV cameras as required by the conditions already agreed.
The Committee noted, in making their decision that there were no objections raised by any responsible authority.
Whilst the Sub-Committee members were sympathetic to the objectors’ fears, we are satisfied that the conditions imposed, together with the Applicant’s commitment to work with the community, can successfully promote the licensing objectives.
